David Ahlheim and Marie Pudlowski obtained a successful result from the Missouri Court of Appeals on an interpretation of Underinsured Motorist Coverage (“UIM”). Plaintiff was a passenger in a single vehicle accident. The vehicle was driven by her husband and died in the accident. Our client argued the familial relationship and fact Plaintiff “owned” the vehicle triggered a “step down” limit to the $25,000 Missouri Financial Responsibility Limit. The Court of Appeals determined that our insurance policy was not ambiguous and allowed for a “stepped down” UIM limits.
